SAN FRANCISCO -- The California Supreme Court today allowed two Riverside County girls to sue a Christian high school that expelled them because the principal believed they were lesbians.
The court unanimously denied review of an appeal by the California Lutheran High School Association, which argued that a religious school has the right to exclude gays and lesbians, regardless of California's anti-discrimination law. Today's action did not resolve that issue but allowed the suit to proceed toward a possible trial.
The girls, both juniors at the school in the town of Wildomar, were expelled in September. According to their lawsuit, which was filed in December, school principal Gregory Bork said he had learned that the students might be involved in a relationship, and coerced one of them into saying she loved the other one.
In a letter to the girls' parents, Bork said the students had violated the school's code of conduct, which prohibits actions "contrary to Christian decency.'' The school is owned by the Wisconsin Evangelical Lutheran Synod, which considers homosexuality sinful.
The suit did not disclose the girls' sexual orientation but claimed the school had violated California's Unruh Act, which prohibits businesses from discriminating on the basis of a person's actual or perceived sexuality. The school argues that it is not a business and is thus exempt from the law. It also says its constitutional rights would override any state law.
"Any implementation of the Unruh Act would contradict the stated position of (the school) that homosexuality is immoral," John McKay, an attorney for the school, wrote in asking the state Supreme Court to halt the lawsuit.

It will be hard to prove or disprove a supposed lesbian status. Regardless the headline propaganda -it is homosexual activity or lack of homosexual activity that is at the determining factor here...

No, if they're not black, hispanic, LGBT, or some other type of minority, the left doesn't care. I mean, how do you expect them to yell "Racism! Racism! Discrimination! Discrimination!" and make Christians look bad if they're white and straight?
I'm sure glad I don't go to that school.

3. Ask Congress to create an affirmative action program for pedophiles as teachers in all preschools and elementary schools.
4. Sue a California couple for discriminatory slander for naming an illegal alien as the man who killed their nine children. (The man plead guilty, confessed, led the police to the bodies, and there were seven witnesses.)
I smell a set-up.
The shoe's on the other foot. Anyone can claim someone else is "gay" or "straight" at any given time, too, and having done so, and having acted on the claim, it's now up to the school to prove it. In the conservative Christian world these girls and their families are a part of, calling someone a homosexual is pretty obviously slander if it isn't true.
Oh, I never meant to imply conservative Christians are 'sleazy'!
